1. Introduction

This Telemedicine Policy outlines the procedures, responsibilities, and legal obligations associated with providing online psychological and psychiatric services through Healmind. We are committed to delivering safe, ethical, and legally compliant mental health care via digital platforms in accordance with Indian laws and guidelines.

2. Legal Compliance

Healmind adheres to the following laws and guidelines:

  • Telemedicine Practice Guidelines, 2020 (Govt. of India)
  • Mental Healthcare Act, 2017
  • The Rehabilitation Council of India Act, 1992
  • Digital Personal Data Protection Act, 2023
  • IT Act, 2000
  • Drugs and Cosmetics Act, 1940 (as applicable)

3. Scope of Services

Healmind offers telemedicine services including online counseling, therapy sessions with RCI-licensed professionals, psychological assessments, and psychiatric consultations. These services are not intended for emergency care.

4. Eligibility of Practitioners

Only qualified professionals may practice on Healmind:

  • Clinical Psychologists (RCI-licensed)
  • Psychiatrists (registered with MCI/NMC)
  • Psychiatric Social Workers (RCI-recognized)

They must hold valid registration and follow professional and ethical standards.

5. Patient Consent

Consent is collected before any session begins:

  • Implied Consent: When a client initiates the session.
  • Explicit Consent: Required when a practitioner initiates or when a third-party is involved.

6. Confidentiality and Data Protection

We comply with the Digital Personal Data Protection Act, 2023. All data is encrypted and securely stored. Client records are kept confidential and may only be accessed with permission.

7. Mode of Consultation

Consultations are offered via:

  • Video (preferred for first-time and diagnostic sessions)
  • Audio
  • Text/Chat (for brief or follow-up sessions)

8. Prescriptions and Medication

Only licensed psychiatrists may prescribe medications. Video consultations are mandatory for such prescriptions. Schedule X and narcotics cannot be prescribed via telemedicine.

9. Emergency Protocols

Healmind is not suitable for crisis management. In emergencies, clients are advised to contact local emergency services or visit a hospital.

10. Documentation and Records

All session-related documentation is securely stored for a minimum of 3 years. Clients can request access in writing.

11. Client Rights and Responsibilities

Rights:

  • Confidential and respectful care
  • Knowledge of therapist credentials
  • Ability to discontinue therapy
  • Informed treatment decisions

Responsibilities:

  • Provide accurate information
  • Maintain privacy during sessions
  • Do not record sessions without consent

12. Disclaimer

Telemedicine is not a substitute for in-person care in severe cases. Healmind is not responsible for technical interruptions or delays.

13. Review and Changes

This policy is reviewed annually and updated as required. Changes will be published on our website.
